Terms of Service
Last updated: October 31, 2026
1. Who we are and what these terms cover
Heirloom Growers Almanac ("Heirloom", "we", "us") is a web-based garden planner. It is operated by Kruger Holdings, LLC, based in Fish Creek, Wisconsin, USA. You can reach us at collin@kruger.farm.
These Terms of Service ("Terms") are an agreement between you and us about your use of the Heirloom website and app at heirloom.krugerapps.com (the "Service"). By using the Service, creating an account, or buying a plan, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
2. What Heirloom does
Heirloom helps home gardeners plan their season. Using your ZIP code or growing zone and your frost dates, it shows a planting timeline, lets you keep seed cards and notes, track what you have planted, keep a planting journal with photos, plan garden beds, and (on paid plans) receive email reminders and frost alerts.
Heirloom is a planning aid, not a promise of results:
- Planting windows are estimates. The built-in seed library holds typical values compiled from public extension and university guides, rounded and edited by us. They will not fit every variety, microclimate, or year. The seed packet in your hand and your local extension office come first.
- Zone and frost dates are averages for a region. You can and should set your own frost dates.
- Frost alerts use forecasts from the U.S. National Weather Service. Forecasts can be wrong or late, and an alert might not reach you. Do not rely on Heirloom alone to protect plants, property, or anything else.
- We do not guarantee any harvest, yield, or gardening outcome.
3. Accounts
You can use much of Heirloom without an account. Your garden is then saved in your own browser only.
To sync your garden to the cloud, or to use a trial or paid plan, you create an account. Sign-in is provided by our authentication provider, Clerk, using Google sign-in or an email-based sign-in. You agree to:
- give accurate sign-in information and keep your sign-in secure;
- be responsible for what happens under your account; and
- tell us promptly if you think someone else has accessed it.
You must be at least 13 years old to create an account. Accounts for children under 13 are not allowed, including accounts created or managed by a parent or guardian.
4. Plans and billing
We offer the following kinds of plans. What each plan includes, and its current price, are shown in the app and at checkout before you pay. These Terms deliberately do not list prices, and the limits of each plan may change over time (see section 4.7).
4.1 Free
The free plan gives you a limited sample of Heirloom. Its limits (for example, how many seeds, plantings, journal entries, or garden beds you can use, and which features are included) are shown in the app. Free use saves your garden in your browser on your device. Clearing your browser data, or switching browsers or devices, can erase it. Cloud sync, reminders, and some other features are not part of the free plan.
4.2 7-day free trial
When you create an account you get a 7-day trial of all features. No payment card is needed to start it, and it does not turn into a paid plan on its own. The trial starts when you first use your new account. When the trial ends, you move back to the free plan unless you buy a plan.
When a trial ends, we do not delete your data. Anything over the free plan limits stays visible but becomes read-only until you choose a plan. Your garden keeps saving in your browser, and cloud sync resumes if you buy a plan.
4.3 Annual (Season Pass), an annual subscription
The Annual plan, also called the Season Pass (the "Season Pass"), is an annual subscription. You are charged when you subscribe and then once a year at the then-current price until you cancel. It renews automatically. We email you a reminder about 7 days before each renewal, with the renewal date and a link to manage or cancel.
You can cancel at any time from your plan badge in the account menu, then "Manage billing" (a Stripe-hosted page). Cancellation takes effect at the end of the period you have already paid for. You keep full access until then, and you will not be charged again.
4.4 Perennial (Lifetime Pass) and lifetime access
The Perennial plan, also called the Lifetime Pass, and any other plan sold as a one-time payment for "lifetime" access, are covered by this section. Lifetime means access to Heirloom for as long as we operate the Service. It does not mean your lifetime or ours. If we ever shut Heirloom down, we will give at least 90 days' notice by email to your account address and on the site, and we will give you a way to export your garden data before it closes. Lifetime purchases are not refunded when the Service shuts down, consistent with section 5. This does not limit any rights you have under applicable law that cannot be waived.
4.5 Limited-time and introductory offers
We may offer introductory or limited-quantity offers (for example, a sale price on the Perennial plan for a limited time). The terms of each offer are shown when it is offered and at checkout. An offer is not a promise that the same offer will return. Promotion codes, when we issue them, may be entered at checkout and follow the terms shown with the code.
4.6 Payment, taxes, and price changes
Payments are processed by Stripe. Your card details go to Stripe, not to us, and we never see or store your full card number. You authorize us (through Stripe) to charge the amounts you agree to at checkout.
The price you see at checkout is the price you pay, plus any sales tax or similar tax we are required to collect. Where required, applicable sales tax is calculated and collected at checkout.
We may change prices for future purchases at any time. If we change the price of the Season Pass, the change applies to renewals starting at least 30 days after we tell you, and you can cancel before it takes effect.
4.7 Changes to plans
We may change what each plan includes, including its limits, and may add or retire features. If you do not like a change, you can cancel a Season Pass at any time (see section 5).
5. Refunds and cancellations
All sales are final. Because every account gets a free 7-day trial of all features with no card required, you can try Heirloom fully before you buy, so we do not offer refunds on the Season Pass, the Perennial plan or other lifetime access, or any other purchase, including renewals. Please use the trial to decide before you buy.
- Cancelling a Season Pass stops future renewals. You keep full access until the end of the period you have already paid for. We do not refund or credit the unused part of that period.
- Cancel before your renewal date if you do not want to be charged for the next year. You can cancel at any time from your plan badge in the account menu, then "Manage billing."
- Duplicate or erroneous charges. If Stripe processes a charge twice or charges you an incorrect amount, contact us at collin@kruger.farm and we will correct it.
- Free plan and trial. These are free, so there is nothing to refund.
This section does not limit any rights you have under the law that cannot be waived.
6. Your garden data and content
You keep ownership of what you put into Heirloom: your seed lists, notes, planting records, journal entries, bed plans, and photos ("Your Content").
You give us a limited, non-exclusive permission to store, process, and display Your Content only as needed to run the Service for you (for example, to sync it across your devices, show it back to you, and use it to send the reminder emails you turned on). We do not sell Your Content, and we do not use it for advertising.
You are responsible for Your Content. Do not upload anything that is illegal, that you do not have the right to share, or that contains other people's private information. Journal photos must be JPEG or WebP files, and size limits apply. When you upload a photo, we strip embedded location and camera metadata (EXIF/GPS) from the file. Photos are stored privately and are only served back to the account that uploaded them.
7. Acceptable use
Please do not:
- break the law or use the Service to harm others;
- try to access other people's accounts or data, or probe or disrupt the Service;
- send automated or excessive requests, scrape the Service, or work around plan limits or billing;
- copy, resell, or redistribute the Service, or the seed library data, outside normal personal use; or
- use the Service to send spam or unsolicited messages (the feedback form is for feedback only).
We may suspend or end access if you break these rules.
8. Email reminders and frost alerts
Reminder and frost-alert emails are optional and available on plans that include them. You choose whether to turn them on, how far ahead to be reminded, and whether to get frost alerts, and you can turn them off at any time in the Reminders tab. Emails go to the address you set there. They are sent on a best-effort basis: we do not guarantee delivery, timing, or accuracy.
9. Our content and intellectual property
Heirloom, its design, logo, text, the seed library as compiled by us, and the software are owned by us or our licensors and are protected by law. We give you a personal, non-exclusive, non-transferable right to use the Service for your own gardening while these Terms apply. Third-party names (for example, seed companies or crop varieties) are used only to identify things and do not imply any partnership.
10. Feedback
If you send us a suggestion or idea (for example, with "Suggest a feature"), you agree we may use it without owing you anything. Please do not include anything confidential.
11. Third-party services
Heirloom relies on outside services, including Cloudflare (hosting and storage), Clerk (sign-in), Stripe (payments), Resend (sending email), the U.S. National Weather Service (forecasts), and a ZIP code lookup service. They have their own terms and privacy practices, described in our Privacy Policy. We are not responsible for outside services we do not control, and they may be unavailable at times.
12. Availability, changes, and ending your use
We work to keep Heirloom running but do not promise it will always be available or error-free. We may change, pause, or discontinue parts of the Service. If we discontinue the whole Service, we will give at least 90 days' notice by email to your account address and on the site, and give you a way to export your garden data before it closes (see section 4.4).
You can stop using Heirloom at any time. You can delete your account yourself from the account menu (see our Privacy Policy); deleting it cancels a Season Pass without a refund and ends any lifetime access. Heirloom does not currently have a bulk data-export tool, though you can print or save your plan as a PDF.
We may suspend or end your account if you break these Terms, if we must for legal reasons, or if your account is used in a way that harms the Service or others. If we end a paid account for reasons other than your breach of these Terms, we do not refund it (see section 5), but where practical we will give you the same notice and a way to export your garden data as described in section 4.4. Nothing here limits any rights you have under applicable law.
13. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that planting dates, forecasts, alerts, or library values are accurate, complete, or suitable for your garden.
14. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost crops, lost plants, lost profits, or lost data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose, or $50, whichever is greater.
Some places do not allow certain limits, so parts of this section may not apply to you.
15. Governing law and disputes
These Terms are governed by the laws of the State of Wisconsin, USA, without regard to its conflict-of-law rules. Any dispute that cannot be resolved informally will be brought only in the state courts located in Door County, Wisconsin, or the federal court for the district that includes Door County (the Eastern District of Wisconsin), and you and we consent to those courts. Before starting a formal claim, please contact us at collin@kruger.farm so we can try to resolve it informally. These Terms do not require arbitration and do not include a class-action waiver.
16. Changes to these Terms
We may update these Terms. We will post the new version here with a new "Last updated" date. If a change is material, we will tell you by email or in the app at least 30 days before it takes effect. If you keep using Heirloom after a change takes effect, you accept the new Terms. If you do not agree, you can stop using the Service and cancel any paid plan.
17. General
If any part of these Terms is found unenforceable, the rest stays in effect. If we do not enforce a right, we have not given it up. You may not transfer these Terms to someone else without our consent. We may transfer them as part of a sale or reorganization of the Service. These Terms and the Privacy Policy are the whole agreement between you and us about the Service.
